Yobinext SAS is a French company registered with the RCS EVRY with the SIREN number 834 153 165. We provide the Transcripion and Editing Service YobiYoba™. This service permits users to upload audio or video data for automatic processing by our transcription software, followed by online editing and export of the textual content.

These Terms of Service ("Terms") govern your access and use of the www.yobiyoba.com website and any software, programs, and materials made available through this website (collectively, the "Service"). In the Terms, the terms "You" and "Your" collectively mean you individually, as well as any entity, such as your employer, authorizing you to access and use this Service.

Please read carefully these Terms of Service as well as our Privacy Policy. before using the Service. When You make use of the Service, in its present form or as it may be modified from time to time, You agree to these Terms, which create a legally binding agreement between You and Yobinext SAS.

We reserve the right, at our sole discretion, to change these Terms of Service at any time. The date at the top of this page indicates the date of the last revision of these Terms. We will also notify You upon your next connection to our website and contact all clients with active accounts by email if the Terms have changed.
If you continue to use the Service after updated Terms have been posted, You agree to these Terms as amended.

If You already have an account and do not agree to any provision of these Terms as currently posted, You agree to immediately notify Yobinext, and cease accessing this Service.

Authorized user, account registration and security

The Service is intended for use by people who are 18 years of age or older. Persons under the age of 18 are prohibited from creating an account. By using this Service, You affirm that You are at least 18 years of age. The Service is for Your personal use or that of Your employer. As a condition to Your continued use of the Service, You warrant to Yobinext that You will not use the Service for any purpose that is unlawful or prohibited by these Terms.

Account registration is required to use the Service. You warrant that You will provide accurate, current and complete information in the registration and other account-related forms on the Service, and in the event of any changes, You will promptly update Your registration information to keep it accurate, current and complete. In addition, You affirm that You have not been previously suspended or removed from the Service and do not already have a YobiYoba account. Yobinext reserves the right to refuse registration, or refuse or limit access to the Service to any person or entity, at our sole discretion. Yobinext may, without notice and at its sole discretion, terminate Your right to use the Service, or any portion of thereof, and block or prevent Your future access to and use of the Service, or any portion thereof.

The confidentiality of Your username and password is Your responsibility and You solely are responsible to Yobinext for activities in Your account. You agree that You will not share Your log-in credentials with others, or do anything that might jeopardize the security of Your account. You also agree to notify Yobinext immediately of any unauthorized or improper use of Your account.

All personally identifiable information that You provide shall remain confidential and shall not be disclosed by Yobinext for any purpose, other than pursuant to a court order for such disclosure issued by a court with appropriate jurisdiction.

When You register and use the Service, or contact us via e-mail, You consent to receive communication from us electronically. Yobinext will communicate with You by e-mail or by posting notices through the Service. You agree that all agreements, notices, disclosures and other communications that we provide to You electronically satisfy any legal requirement for written communications.

License to access and use service

The Service is the property of Yobinext SAS and Your access to the Service is solely with our permission. Yobinext accords you a limited, non-exclusive, non-transferable, revocable license to use the Service, subject to these present Terms of Service. You are strictly prohibited from accessing and using the YobiYoba Service without agreeing to these Terms of this Service. You agree that You will not defeat, circumvent or modify any authentication process or other security measures, controls, limitations, or content or functionality filters contained in or associated with this Service, or otherwise attempt to access any aspect of the YobiYoba Service for which You have not been granted authorization. You expressly agree that You will only use the Service for lawful purposes.

Term and termination

The term of Your authorization to access and use the Service is for an indefinite period of time. However, if these Terms are not respected, Yobinext may terminate Your rights to access and use Service at any time, at its sole discretion, by written notice to You delivered to the email address that You provided with Your registration information. Yobinext's termination of Your rights to access and use the Service for any such breach is not an exclusive remedy and Yobinext reserves all other rights at law and in equity it may have against You for any such breach.

Charges

Once payment is made and credit has been allocated to Your account, Yobinext has no obligation to refund this payment or any credit remaining on Your account. All charges are inclusive of VAT, where applicable.

Disclaimer of warranties

Yobinext does not warrant accuracy of the processing performed by the Service. The Service is provided as is, with no warranty of any kind on the quality of results, including unconditional minimal quality or appropriateness for a particular purpose. Yobinext does not guarantee any results, quantitative or qualitative, express or implied, of any nature whatsoever in connection with the use of Service.

Under no conditions can Yobinext be held liable for any damages whatsoever (including, without limitation, damages for loss of turnover, profits, data, or activity interruption) associated with the use or inability to use the Service, even if Yobinext has been advised of the possibility of such damages.
